Town of Rochester Supervisor Carl Chipsman Chipman has shown support for gambling at Nevele, Granite and Pinegrove. I invite him to explain why there is no gambling he doesn’t like. But shhh!… let him read this first:

Where’s the Payoff in Gambling?

For those who promote legalized gambling as a means of economic development or revitalization, or as a painless way to pay for public schools, the recent news from Atlantic City, NJ, is sobering.

Dominated by its famous Boardwalk, the beach resort is familiar to Americans from the popular game of Monopoly, the Miss America pageant, and the Democratic Convention that nominated Lyndon B. Johnson for president. Almost forty years ago, when casino gambling was prohibited by every state except Nevada, New Jersey voters succumbed to a slick campaign that promised to remake the fading resort into Las Vegas East.

For awhile it seemed to work, as people from all over the northeast rode buses to Atlantic City to sit for hours in front of mesmerizing slot machines. But casino revenues have fallen steadily to where they were 25 years ago, and this year four of Atlantic City’s 11 casinos closed their doors, with a fifth expected to follow soon.

The closed casinos have eliminated 8,000 jobs in a city whose unemployment rate was already twice the national average, and the assessed value of the unoccupied properties will have to be sharply reduced. And no property was bigger or fell harder than the gargantuan Revel Casino Hotel, which was custom designed for high-rollers who never showed up.

What can be done with a 57-story, hermetically sealed glass building with 1,400 hotel rooms and 10 swimming pools occupying 20 acres on the Boardwalk? When it filed for bankruptcy a second time last month, the owners declared the value of the property was worth less than 20% of what it cost, telling the bankruptcy judge that the casino is “a melting ice cube.”

The $2.4 billion it cost to construct that now-useless “glass elephant” was greater than the taxes New Jersey collected from all the other casinos in the past eight years. New Jersey Governor Chris Christie had the chance to pull the plug on the project four years ago, but instead he doubled down, committing $261 million of state funds to see it through to completion.

Atlantic City parallels what happened in Alton, Illinois, where my husband and I lived for 44 years raising our six children. A riverboat casino was touted as the new “services” economy to replace the manufacturing plants that once supported over 10,000 families there.

After the politically connected original investors cashed in their chips a decade ago, Alton’s casino steadily declined to about half of its original revenue. Along the way, a local family-owned business was devastated when a trusted employee embezzled over $100,000 to support her gambling losses “on the boat,” as people still say although the so-called boat never leaves the dock anymore.

While Christie was bailing out the soon-to-collapse Revel Casino, he also committed New Jersey to enter the untested field of internet gambling, which enables people to lose their life’s savings in one fit of depression, without even leaving their office or home. Internet betting preys on the compulsive gambler because it invites him to feed his habit in secret, without criticism by family or friends.

Gambling over the internet was deemed illegal based on a 1961 law called the Wire Act. As recently as 2007, the FBI was warning Americans that it is against the law to gamble over the internet, and the operators of online virtual casinos were prosecuted.

But in another example of the Obama Administration changing a law without congressional approval, its Department of Justice surprisingly announced just before Christmas 2011 that many forms of internet gambling are legal after all. Obama’s DOJ declared that the Wire Act prohibited sports betting, but implied that other forms of gambling (such as online poker) may not be considered illegal under the Wire Act.

At that time – nearly three years ago – the size of online gambling was estimated to be already immense, between $6 billion to $100 billion a year. Chris Christie obviously salivated at the prospect of collecting a share of that money for New Jersey, projecting $180 million the first year — almost as much as the state now takes in from casinos.

But the state’s actual revenue from internet gambling this year was only a little over $9 million, which is 95 percent less than Christie expected. Meanwhile, more conservative states (such as Texas) have held the line against gambling expansions.

The lesson of New Jersey should not be lost on Republicans who are vetting potential presidential candidates for 2016. Some of the Republican “donor class” may be considering Chris Christie, who is not a conservative, as someone who could control the federal budget after eight years of Obama’s deficit spending.

Like the liberal Republicans who are currently running for governor of two other blue states, California and Illinois, Christie offers himself as a non-ideological pragmatist who can manage the state’s finances. The catastrophe of Christie’s bad bet on gambling, both virtual and bricks-and-mortar, proves yet again that there simply is no such thing as a viable “social liberal, fiscal conservative.”

It’s all about the vacant seat on the Rochester Town Board
Ulster County Republican Committee member and former Town of Rochester Councilwoman Manuela Michailescu lost the nomination of the Rochester Republican Caucus to Cindy Fornino – a registered Conservative, the wife of Rochester Conservative Party chairman Gerry Fornino. I will re-visit this paragraph one of these days; for now I want to focus on the caucus.

The 2014 Town of Rochester Republican Caucus was something else.
Something fake like… whatchamacallit?… a Conservative Caucus, only ten times bigger. Otherwise, this caucus brought us a bunch of firsts.

FIRST Republican Caucus kept under wraps
A 3-line legal notice buried in a newspaper nobody reads covers your ass legally, not ethically. Moreover, the Republican Committee member Imre Beke – of the Virgin Mary Cancer Pills fame – misled fellow Committee member Manuela Michailescu about the date of the caucus.

Danny Aversano, the freshly minted chairman of the Rochester Republican Committee, tried to fly this caucus under the radar, as ordered by Terry Bernardo. So much so that without the intervention of fellow Committee member Manuela Michailescu, this caucus would have been illegal. You read that right: I-L-L-E-G-A-L. Two hours before the deadline, Manuela checked if the caucus notice was filed with the Town Clerk and posted at the Town Hall. It was not. Manuela called Aversano and made him correct the situation. Aversano’s lame excuse: “Nobody told me.”

With the exception of the people who learned the date of the caucus on this blog or from my and Manuela’s Facebook pages, all others were invited to attend in order to vote for Cindy Fornino.

FIRST Republican Caucus completely taken over by Terry Bernardo
I arrived 30 minutes earlier, in time to witness the frantic staging of the caucus. In the past, Republican Committee members – with help from the rank and file – prepared the caucus venue. This time, under Terry Bernardo’s direction and supervision, the Conservative Party chair Gerry Fornino, helped by family and Bob Garrett, moved furniture and prepared the seating, assigning two chairs to a six-person Republican committee, obviously trying to steal Manuela’s seat at the table. The place was awash in whispers and hostility.

Ulster County Legislator Ken Ronk came all the way from Shawangunk to explain to Aversano how the caucus works, despite the fact that the new Chair could have asked for help in our own town.

FIRST Republican Caucus ashamed of itself
Chairman Aversano opened the meeting welcoming the audience to “our Caucus,” not to “the Republican Caucus.” He did not introduce the four present members of the Rochester Republican Committee, Manuela Michailescu among them.

Displaying disloyalty and lack of respect for the Republican candidates, Aversano started the nomination process with the Conservative candidate – a moronic move surely imposed by Terry Bernardo. Moreover, Aversano didn’t state that Cindy Fornino belongs to a different party. When Committee member Manuela Michailescu made him do the right thing, Imre Beke – always the loyal servant of Terry Bernardo – felt the need to mumble in the name of the Committee: “and we support Cindy Fornino!” My dear Beke, you might support a candidate as a private person, but the Committee is not allowed to support candidates for town offices. It’s the law, genius!

Next, Chairman Aversano – despite being given written information about Manuela Michailescu’s candidacy – played cute and replaced the required “the Chair recognizes Kandy Santosky for the purpose of a nomination” with a disrespectful “anybody else?”

Yep, Imre Beke, with an idiotic smile and a bobbing head, confirmed to everybody in Fornino’s camp that Cindy won the nomination, long before Chairman Aversano made the official announcement.

Yep, no matter how crooked you are, pangs of conscience might tickle your belly.

It was obvious to everybody attending the caucus: a coalition of unsavory characters conspired to stage the caucus to get rid of Manuela. In the near future I’ll take my sweet time to skewer all of them. The messages received by Manuela after the caucus confirmed my suspicion that I’m not crazy. Many other people saw the same dirty deal:

They are talking unity in the town, that will never happen as long as everyone is stabbing every one else in the back… Including Carl… I just don’t know how you do it dealing with all these phony people… You are one strong lady… I take my hat off to you…

Hi Manuela. I hoped you win the nomination. You have to dig deep and figure out what they have against you. Something is obviously not right. Are you sure you want to sit with such inadequate people? You deserve better than that. My fingers were crossed. However, I felt that they made their own private decisions and made it look like it’s out in the open. That’s politics. Crooked as a broken toe!

Manuela, I really think they have black listed you because they don’t like Jon. But, their loss. They don’t deserve your skills. At this point, if I were you, I would not bother helping them with ANYTHING. Let them figure it out for themselves.

Then the speech about coming together! that was a joke. If you want people to come together, nominate and elect from your own party! Cindy should be running on the Conservative line, not the Republican line when we have a Republican that wants to run.

It was another deal so let’s see what they really get out of it.
I am not expecting much more than continuous 5:0 voting and nothing really getting done.

It was all so pre-planed. I am sure that Carl and Cindy’s husband are friends. I bet it was already a done deal. The deserving party never gets a true vote or a chance to win. That is crooked politics. We do not have room for that in our town. Just try to relax and know that it is not you. It is them that treat the positive person so negatively.

Manuela, I just read again all the applications. I cannot believe how obvious it was that they chose Cindy due only to friendship. Definitely you should have been chosen. How unfair. How ludicrous Carl now looks. He should be ashamed of himself. I am ashamed to read these resumes and see that she was voted in based on that. I really have no other words. I am just saddened.

It’s disturbing to say the least. So corrupt from town level up. Love you – the good will prevail.

You know Carl is a weak man – he’s so worried about losing his position that he bends like a reed in the wind. It’s a shame – I used to think he was a man of conviction. Wrong!

For some reason the local Conservative party has their own private ‘get Manuela’ agenda, apparently they still hold on to it.  When I questioned one of them, a member, he had no answer. Just don’t let it get you down, it is beyond logic,  maybe it’s ethnic, you know what a screwy political town this is. I would not lift a finger to help advance Carl on anything, including his stupid reasoning excuse for mishandling the trash site. His first obligation to this town was to clean it up, period.

“New Jersey governor Chris Christie made a big bet on a casino in Atlantic City and lost. After putting $260 million in tax credits on the table, plus millions for worker training and infrastructure investments, the taxpayers of New Jersey are saddled with a white elephant: The casino, housed in the largest and most prominent building in Atlantic City, has gone into bankruptcy twice and will close its doors in September, putting some 3,100 people out of work.

Governor Christie should have known better: Investors had been walking away from the project for years, with Morgan Stanley taking a loss of nearly $1 billion rather than moving forward as an investor and the Export-Import Bank of China considering and then rejecting an investment in the casino.

Gambling has always been a rotten business, but with casinos springing up everywhere from rural New York to the suburbs of Philadelphia, Atlantic City’s former monopoly position for East Coast gambling has been steadily eroding.

The next time a politician comes along talking about making “investments” for jobs and growth, remember that government is a terrible gambler and a worse investor. Leave it to government to turn gambling into a business where the house always loses.”

…I’m sick and tired of all the rumors and suggestions from various factions ever since Tavi decided to buy property in Tennessee. If Tavi Cilenti resigns, we will advertise and interview applicants for the open seat. There will have to be 3 out of 4 of the members of the board agreeing on a candidate for an appointment to be made. If that is not possible, then the law provides for the governor to appoint someone until an election could be held in November…

…We need less concern for power and influence in our community and more concern as to making our town a better place to live, work, and play.

Cilenti Resigns from Rochester Town Council
Chipman Promises Transparent Replacement Process

Town supervisor Carl Chipman read Cilenti’s letter of resignation at the August 7 meeting of the board, and laid out a process for seeking a replacement until a special election can be held in November…

Calling it the “open and proper way to do this,” Chipman asked his board to approve a resolution directing the town clerk to publish a notice of the vacancy… Town residents are invited to submit a letter of interest to the clerk by August 25, and the board will interview those candidates at their August 28 workshop meeting, which begins at 5:30 p.m. The board will then decide who will fill the open seat.

So far, so dandy, but it’s more to it… Long before the deadline for submitting applications, everybody knew that the chairman of a major political party called his people on the Town Board and asked them to vote for a certain candidate, who happens to be registered in the other major political party! Fishy, ain’t it? Long before the deadline for submitting applications, everybody knew already who is going to be appointed by the Town Board.

In my limitless stupidity I thought that the appointment to the vacant seat must be made based on a person’s record and specific experience for the position.

So, being curious about candidates’ record and experience, I splurged on a FOIL request. What follows is the list of the candidates for the vacant seat on the Rochester Town Board. The thumbnails under their names show all pages of their applications. Click on the thumbnails to read for yourself. Under each name, I took the liberty to insert my two cents.

Apparently nobody knows his name. On the town’s website he is listed as Cliff Mallory. On the Ulster Literacy Association website he is listed as Cliff Mallory. Makes one wonder if he ever had the curiosity to visit one of these websites. And if you think accuracy is not important, google Mallory and Mallery and compare the results.

What I really love is the corporate ethics of Mr. Mallery’s former employers:

“At issue are allegations that JPMorgan and firms it later purchased, Bear Stearns and Washington Mutual, sold risky mortgage securities during the housing bubble while misrepresenting their quality. These securities later failed in huge numbers, playing a key role in the 2008 crisis.”

From Albany Doubling Down as Casino Boom Fades (The New York Times):

ALBANY — New York State is charging headlong into the casino business, with four full-service gambling resorts expected to be approved this fall and opened as early as next year, and talk of a torrent of new revenue, thousands of new jobs and a powerful economic jump-start for long-depressed upstate communities.

Supporters of the expansion — most notably Gov. Andrew M. Cuomo — hope it will reverse the fortunes of economically stagnating regions like the Catskills, where little has filled the void left by the demise of the borscht belt.

But analysts, economists and casino operators warn that the industry is already suffering the effects of fierce competition, if not saturation, even in the Northeast, once a rich, untapped market. Winnings are flat or shrinking in many places. Casinos in Atlantic City are closing; Foxwoods, in Connecticut, is cutting costs. The longstanding image of gambling as a no-doubt winner for state governments has quietly gone the way of a bettor’s bankroll after too many hours at the tables.

None of which bodes well for the long-term goals of Mr. Cuomo’s plan.

“He’s 15 years too late to the party,” said Harold L. Vogel, a longtime gambling industry analyst.

Nevele developer considers project tax breaks appropriate (Daily Freeman):

ELLENVILLE – Nevele Casino, Resort and Spa Chief Executive Officer Michael Treanor said he considers the five-year period with a tax freeze at about one percent of full property value to be an appropriate exchange for the amount of community benefits a casino will bring at a time when the gaming industry is experiencing a downturn.

“The northeast of the United States is approaching a saturation point of gaming,” Treanor said. “It is a topic of conversation with our investors. I don’t think people are overly troubled by what’s happening in Atlantic City because Atlantic City has been declining for years. …As [new] states have come online, it has broken the monopolistic nature of Atlantic City on the east coast.”

News outlets report that one Atlantic City casino closed earlier this year, a second will close at the end of the month, and a third has threatened to close if a buyer is not found.

Mr. Treanor makes some interesting points: “The northeast of the United States is approaching a saturation point of gaming,…” So is this a good time to build more casinos? “…the financing community looks at the Nevele project … as just a business.” In other words, the “project” is too risky without a guaranteed PILOT. “… he considers the five-year period with a (PILOT) to be an appropriate exchange for the amount of community benefits the casino will bring”. Well the rest of us don’t see it that way. Let Treanor and his investors finance the Nevele with their OWN money in this already saturated market, and Ulster taxpayers will finance their own fire apparatus, air traffic studies, and DARE. I hope the IDA sees through Treanor’s BS, and doesn’t leave us holding the bag a la SkateTime, Armor Dynamics, and the Aaron’s fiasco! (Hurleyguy)

Mr. Treanor, what you are asking is that those who are going to be coming to your place pay to have it built and pay to play. You want your cake and to eat it also. You only get one piece of the pie! Give it up and let some other county have it. (obaki)

The voters who approved the new casinos in NY were expecting to collect taxes, not give special tax breaks. If a business can’t survive while paying its fair share then the entire tax system needs to be reconsidered. Giving a tax break to one business adds to the tax burden on everyone else, and we already know that the high taxes in NY are a problem for everyone. (wallyagain)

After the NYS Board of Elections invalidated a sizable chunk of the signatures on her nominating petitions, Susan Zimet announced this past Monday that she is off the ballot in the 103rd state Assembly District race.

…Zimet, who planned to run in a Democratic primary against incumbent Kevin Cahill, blamed challenges by Cahill to her nominating petitions.

“Cahill’s actions to keep me off the ballot makes one wonder why he is so scared of letting the voters have the opportunity to cast their vote,” Zimet, the current town of New Paltz supervisor, said in a prepared statement.

Really Susan? Are you accusing Cahill of denying voters a choice by challenging your petitions? If you are, here is something I treasure, a comment posted a few years back on FreemanOnline.com by mikeb:

Why is every petition challenge always seen as “dirty tricks and manipulation of the law?” How about it is the law?

And if you can’t, as a candidate, follow and understand the law enough to get your petitions correct, why would I even consider electing you to an office where you would be governing?

If you don’t like the law, fight to change it, but don’t just ignore it or try to make it out as something trivial and insignificant.

I suppose that Zimet announcing on Facebook her run for State Assenbly [sic] was also Cahill’s doing.
